Gateway 3: The Final Safety Check Before You Build
The Building Safety Act 2022 introduced a new framework to improve building safety throughout the design and construction process. One of the most critical components of this framework is Gateway 3 — the final stop before occupation of a higher-risk building (HRB).
But what exactly is Gateway 3, and what does it mean for developers, contractors, and clients?
What is Gateway 3?
Gateway 3 is the completion and final approval stage of a project under the new building safety regime. It occurs after construction is complete but before the building can legally be occupied. This applies to higher-risk buildings (HRBs) — typically residential buildings over 18 metres or 7 storeys tall with at least two residential units.
At Gateway 3, developers must submit a completion certificate application to the Building Safety Regulator (BSR). This application must demonstrate that the building work complies with Building Regulations and that ‘golden thread’ of safety information has been captured and stored throughout the project.
You Cannot Occupy Without It
No one can occupy the building — even partially — until the BSR has issued a completion certificate and the building has been added to the public HRB register. This puts real weight behind Gateway 3, as any delays or missing documentation can directly impact move-in dates and project timelines.
What Must Be Submitted?
The application must be accompanied by:
- As-built drawings
- Construction control plan
- Safety case report Fire and emergency file
- Compliance declarations from the principal contractor and principal designer
- Golden thread data
- Change control logs
This ensures the BSR has full transparency over how the building was constructed, what materials were used, and whether design intent was followed.
In addition to the above, the Accountable Person (or Principal Accountable Person) must be identified and prepared to fulfil ongoing building safety management duties, including maintaining the golden thread and managing building safety risks.

Gateway 3 shifts the focus toward accountability and traceability. It makes sure that what was designed is what was built — no shortcuts, no substitutions of safety-critical elements, and no grey areas. If any issues have arisen during construction, they must be documented and resolved before anyone can move in.
For developers, contractors, and clients, this means:
- Greater emphasis on digital record-keeping
- Stronger collaboration across the project team
- A real need for early planning of safety documentation
The consequence of not meeting the requirements of Gateway 3 can be severe, with potential delays to rental receipts or property sale income impacting cash flow right through the supply chain.
